I. DEFINITIONS

  1. The terms used in these Terms and Conditions shall have the following meanings:

Stenerg – Stenerg Sp. z o.o. with its registered office in Kamień, ul. Duble 71, registered in the National Court Register under KRS No. 0001101322, NIP 5170446849, REGON 52841018900000.
Service – this website built and operated by Stenerg Sp. z o.o. under the domain www.stenerg.pl.
Terms and Conditions – the terms and conditions for using the Stenerg Sp. z o.o. Service (available, among others, at: www.stenerg.pl/polityka/).
User – any person using the Service.

II. GENERAL PROVISIONS

  1. The purpose of these Terms and Conditions is to define the terms of providing services via the Service operated at www.stenerg.pl for Users.

  2. Under these Terms and Conditions, the User may ознакомиться with the content made available in the Service and use the Service in such a way as to access it at a time and place of their choosing, regardless of the type and method of operation of the device or application used for this purpose.

  3. A necessary condition for using the Service is accepting the Terms and Conditions. By using the Service, the User agrees to comply with these Terms and Conditions and any amendments introduced by Stenerg.

  4. The User confirms that they are of legal age and have full legal capacity, including in particular the capacity to perform legal acts related to the use of the Service.

  5. Stenerg shall not be liable for errors in published information but makes every effort to ensure that the information and images published in the Service are displayed correctly. Any display errors may result from incorrect User device settings or incompatible configuration.

  6. To the maximum extent permitted by law, Stenerg limits its liability toward the User and shall not be liable for any damages or losses incurred by the User arising directly or indirectly from the use of the Service, transactions related to the Service, or disclosure of data, subject to mandatory statutory rights.

  7. Stenerg strives to ensure that the servers hosting the Service are free from computer viruses and other harmful software but shall not be liable for damages caused by viruses or malicious software introduced by third parties despite compliance with data security rules.

III. SERVICE CONTENT

  1. The content and layout of the Service are protected by copyright, industrial property rights (including trademarks), database protection laws, and other intellectual property laws under national and international regulations. Reproduction, modification, distribution, or copying of any content or layout of the Service is prohibited.

  2. All economic copyrights to works available in the Service belong to Stenerg and are protected by law. The User acknowledges the existence of copyrights, trademarks, patents, and related rights associated with the content owned by Stenerg.

  3. The User acknowledges that know-how, trademarks, logos, and other distinctive marks displayed in the Service are legally protected (regardless of registration), and no content in the Service grants any license to the User.

  4. Use of the Service and its materials is permitted only within the scope of fair use as provided by copyright and database protection laws.

  5. Technical data provided in the Service or other informational documents are for reference only, and Stenerg does not guarantee their accuracy.

  6. All applications, software, layout, and other content provided during use of the Service are the property of Stenerg or its affiliated entities and may not be used beyond the scope of the Service. They are provided “as is,” and Stenerg does not guarantee their proper operation.

  7. It is prohibited, without limitation:
    a) to copy, reproduce, or duplicate any part of the Service content;
    b) to use, transfer, copy, or reproduce any part of the Service (or its source code) beyond displaying it on one’s own device or printing for personal review;
    c) to distribute Service content;
    d) to modify, adapt, or create derivative works;
    e) to grant licenses or sublicenses to the above rights.

  8. Information in the Service, including product information and installation methods, is for informational purposes only.

  9. Information published in the Service, including product descriptions, brochures, advertisements, and potential benefits, is for reference only and may change at any time. It does not constitute an offer under the Civil Code, even if prices are indicated, but rather an invitation to contact Stenerg. Prices are specified in official price lists valid for the indicated period. For customized orders, prices are determined individually and require separate acceptance if different from standard price lists.

IV. LIMITATION OF LIABILITY

  1. The Service is provided “as is,” and the User uses it at their own risk, bearing full responsibility for any damages or losses arising from reliance on Service content. Stenerg’s liability applies only where mandatory law does not allow exclusion.

  2. Stenerg is not liable for improper use of Service content or for indirect, consequential, economic losses or lost profits.

  3. Stenerg and telecommunications providers are not liable for damages resulting from use or inability to use the Service, or from accuracy, completeness, or suitability of its content.

  4. Stenerg does not guarantee that the Service or its server is free from defects, viruses, or harmful components.

V. COOKIES

  1. The Service uses cookies stored on the User’s device.

  2. Stenerg may collect visit data such as IP address, browser type, and operating system.

  3. Cookies are used solely to improve Service performance, including:
    a) adapting the Service to User preferences;
    b) maintaining sessions and remembering settings;
    c) compiling statistics and analyzing popularity.

  4. Browsers allow cookie storage by default; using the Service implies consent to cookies.

  5. Users may block cookies via browser settings.

  6. Users can configure cookie storage through browser settings.

VI. COMPLAINT PROCEDURE

  1. Users have the right to submit complaints regarding the Service.

  2. Complaints should be sent to: biuro@stenerg.pl or Stenerg Sp. z o.o., ul. Duble 71, 36-053 Kamień.

  3. Complaints will be reviewed within 14 days.

  4. The response will be sent to the address provided by the User.

  5. The review period may be extended by up to 10 days if necessary due to exceptional circumstances.

VII. FINAL PROVISIONS

  1. The Service respects User privacy; the Privacy Policy is available on the website.

  2. Stenerg makes every effort to ensure accuracy but does not guarantee absence of inconsistencies.

  3. Confidential data exchanged with www.stenerg.pl are encrypted via SSL. The Service is not responsible for privacy practices of external websites.

  4. Stenerg may temporarily suspend the Service for maintenance or updates.

  5. Service content may not be published elsewhere without Stenerg’s consent.

  6. The Terms and use of the Service are governed by Polish law. Disputes fall under the exclusive jurisdiction of Polish courts.

  7. The Terms enter into force on 1 July 2024.

In accordance with Regulation (EU) 2016/679 (GDPR), we inform you that:

  2. Personal Data Processing

a) Job Applicants – data processed for recruitment based on consent. Required data: name, surname, address, education, experience. Storage: up to 6 months (24 months with additional consent).

b) Contacting Persons – data processed for communication based on legitimate interest. Data: name, email, phone, correspondence address. Storage: until deletion request or as required by legitimate interest; for complaints – until completion of complaint process or warranty period.

c) Contractors and Representatives – data processed for contract conclusion/performance or legitimate interest. Data: name, email, phone, workplace, position, business details, NIP, REGON, PESEL, ID/passport (if applicable). Storage: duration of contract and claims period.

d) Visitors – data processed for identification and security (monitoring, name). Storage: monitoring up to 3 months; other data up to 2 years.

e) Marketing Participants – data processed for communication or based on consent. Storage: until completion of promotion/contest or as required by legitimate interest.

  1. Data Sharing
    Data may be shared with authorized authorities and service providers (e.g., IT, legal advisors) under agreements with the Controller.

  2. Automated Decision-Making
    Data are not processed for automated decision-making or profiling.

  3. Data Subject Rights
    Right of access, rectification, erasure, restriction, objection, data portability, withdrawal of consent, and complaint to the President of the Personal Data Protection Office.

  4. Source of Data
    If not obtained directly, data may come from contractors, social media, the Internet, or publicly available sources.
